1. Introduction
These Terms and Conditions govern the services provided by Tyburn Service Centre, an independent UK garage located at 375 Tyburn Road, Erdington, Birmingham, B24 8HJ. By booking, authorising, or using our services, you agree to these Terms and Conditions. If you do not agree, please do not use our services.
2. Service Agreement
a. Tyburn Service Centre agrees to provide vehicle servicing, MOT testing, repairs, diagnostics, and related services (the “Services”) in a professional and timely manner.
b. You must provide accurate and complete information about your vehicle (including make, model, registration, mileage, and known faults/symptoms).
c. We may refuse or stop work if a vehicle is unsafe to work on, if we cannot obtain required parts, or if the scope of work becomes unreasonable or impractical.
3. Estimates, Pricing and Payments
a. Where possible, prices and estimates are provided in advance. An estimate is not a fixed price and may change if additional faults are found once work begins.
b. We will seek your authorisation before carrying out additional work that increases the price beyond the agreed estimate (unless urgent safety-related work is required to prevent damage or danger, in which case we will attempt to contact you first).
c. A deposit may be required for certain work (including special-order parts).
d. Payment is due on completion and prior to vehicle release unless otherwise agreed in writing.
e. We accept cash, debit/credit card, and bank transfer. Cheques are not accepted.
f. Late payment may result in additional charges, including reasonable administration and recovery costs, where applicable.
4. Parts and Materials
a. We use quality parts and materials appropriate for your vehicle and the work requested. Unless otherwise agreed, parts may be OEM, equivalent quality, or approved aftermarket.
b. If you request specific parts or supply your own parts, you are responsible for suitability and any additional fitting time/costs. Warranty may be limited or excluded on customer-supplied parts.
c. Removed parts will be disposed of unless you request to retain them before work starts (where legally and safely possible).
5. Warranty
a. We provide a warranty on labour and parts supplied by us, subject to the nature of the work and manufacturer terms. Warranty details will be confirmed at the time of service.
b. Warranty may be invalid if:
- The vehicle is misused, modified, neglected, or involved in an accident after the work.
- Repairs or adjustments are carried out by a third party without our prior written consent.
- Recommended maintenance, service intervals, or post-repair instructions are not followed.
c. Warranty does not cover general wear and tear, consumables (e.g., tyres, brake pads, bulbs, wiper blades) unless directly related to the work performed, or faults unrelated to our work.
6. MOT Testing
a. MOT tests are carried out in accordance with DVSA requirements.
b. If your vehicle fails, we can provide an estimate for repairs. No repair work will be carried out without your authorisation.
c. Re-test eligibility and fees depend on DVSA rules and the time between tests; we will advise at the time.
7. Vehicle Storage and Collection
a. Vehicles should be collected within 48 hours of notification that the work is complete unless we agree otherwise in writing.
b. A daily storage charge may apply to vehicles not collected within this period.
c. We are not responsible for loss, damage, or theft of personal belongings left in the vehicle. Please remove valuables before handing the vehicle over.
8. Liability and Limitations
a. We will provide services with reasonable care and skill. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
b. We are not responsible for pre-existing faults, hidden defects, or unrelated failures that occur after service completion.
c. We are not liable for indirect or consequential losses (including loss of earnings or business) arising from the provision of the Services, except where required by law.
9. Customer Responsibilities
a. You are responsible for providing accurate vehicle details and disclosing known issues.
b. You must authorise any additional work beyond the agreed scope.
c. You are responsible for arranging vehicle delivery/collection, unless we agree otherwise.
d. Any concerns or complaints should be raised as soon as possible and, in any event, within 7 days of completion so we can investigate and resolve promptly.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. The latest version will be available on our website and will apply to new bookings from the date of publication.
